Options for transferring data to courts

Issuing court orders is the responsibility of courts that handle dunning proceedings in the province where the creditor (claimant) or creditor’s company is domiciled. There are usually one or two central courts that handle dunning proceedings in each German province.

Data transfer using data carriers/long distance data transmission – A number of states allows data transfer to the courts using data carriers or long distance data transmission. For data carriers transfer, data needed for issuing a court order is saved on disks and then transferred to the courts. When transferring data via long distance data transmission, the data is transferred via email or the Internet. Permission of the relevant court is needed before engaging in data transfer described above. In the case of labour court reminder procedures, a data transfer via data carriers is principally not possible.

If data transfer using data carriers or long-distance data transmission is possible in your province, the authorised parties (e.g. our law office) can provide the necessary data media through our special dunning software and/or convey the data via long-distance data transmission to the court. The court will then issue the requested court order and send it to the debtor usually one day after having received the data. It normally takes 3-5 working days from the issue of the court order to receipt by the debtor.

Dunning procedures using conventional forms – In labour court procedures and in certain provinces, it is not possible to obtain a court order using data carriers or long distance data transmission. A conventional form must be completed to request a court order which cannot be machine-read by court. This procedure normally takes between 2-6 weeks from requesting a court order to sending the order to the debtor.

Please note that in some provinces it is only possible for companies and law offices to obtain court orders via the automated procedure. Private persons must still request court orders using conventional procedures. For reminding proceedings involving labour court, data transfer is only possible using conventional forms.
